All quotations are based on the information and specifications available to us at the time the quotation is prepared.
Depending on the design, a quotation may be based on estimated:
  • Metal weight
  • Gemstone size or weight
  • Ring size
  • Dimensions
  • Manufacturing requirements
  • Labour
  • CAD design
  • Setting
  • Finishing
  • Engraving
  • Other specialist services
Where the final requirements differ materially from the original specifications, the final price may need to be adjusted.
We will communicate any material price changes before proceeding where required.
A quotation does not constitute a guarantee of the exact final metal weight unless this has specifically been agreed in writing.
Your order is considered accepted when you:
  • Accept or sign the quotation;
  • Pay the required deposit;
  • Approve the design;
  • Give written confirmation to proceed; or
  • Otherwise instruct Cloverfield to begin the work.
Once an order has been accepted and work has started, Cloverfield may have incurred costs that cannot reasonably be recovered.
These may include design work, CAD work, materials, gemstones, manufacturing, casting, setting, engraving and third-party services.
A deposit is required before custom manufacturing begins.
Unless otherwise stated on your quotation, our standard deposit is 60%–70% of the quoted price.
The remaining balance is payable before or upon collection/delivery of the completed jewellery.
Deposit payments
A deposit secures your order and allows Cloverfield to begin the design and manufacturing process.
A deposit does not automatically become refundable simply because a client changes their mind after work has commenced.
Where a client lawfully cancels an order, Cloverfield may retain or recover amounts that we are legally entitled to retain or recover, taking into account:
  • Work already completed;
  • Design and CAD work;
  • Materials purchased;
  • Gemstones purchased;
  • Manufacturing already performed;
  • Third-party costs;
  • Non-refundable costs; and
  • The stage at which the order was cancelled.
Any cancellation amount retained by Cloverfield will be limited to what is legally permissible and reasonable in the circumstances.
Nothing in these Terms removes a statutory right to a refund where one applies.
We strongly encourage clients to carefully consider their design, measurements, gemstones, metal and specifications before approving an order.
Because custom jewellery is made specifically for you, cancellation after production has started can result in significant costs.
If you cancel a custom order after work has commenced, Cloverfield may, where legally permitted, deduct reasonable costs already incurred from any amount refundable to you.
The amount will depend on the stage of the order and the costs incurred.
For example, costs may include:
  • Consultation and design work
  • CAD design
  • Custom modelling
  • Materials
  • Gold or other precious metals
  • Gemstones
  • Casting
  • Setting
  • Engraving
  • Manufacturing
  • Outsourced services
  • Courier or shipping costs
We will not apply a blanket “no refund under any circumstances” rule where South African law provides a consumer with a refund or cancellation right.
Natural gemstones are unique products of nature.
Each stone may have natural variations in:
  • Colour
  • Tone
  • Saturation
  • Clarity
  • Inclusions
  • Transparency
  • Shape
  • Internal characteristics
Two natural gemstones of the same type can therefore look different.
Photographs and videos may also appear different from the physical gemstone because of lighting, cameras and screen settings.
Where a specific gemstone has been selected and approved, Cloverfield will take reasonable care to ensure that the agreed stone is used.
Cloverfield may manufacture new jewellery using gold or other precious-metal items supplied by you.
When you provide your own jewellery or gold, you understand and agree that:
Your original jewellery may be permanently altered
If your jewellery is melted, refined, cut or otherwise processed, its original form may not be recoverable.
Weight may change
The weight of your original jewellery does not necessarily equal the amount of usable precious metal recovered.
Existing jewellery may contain:
  • Solder
  • Alloy metals
  • Plating
  • Springs
  • Non-precious components
  • Other materials
The recoverable precious-metal content may therefore be lower than the original gross weight.
Manufacturing losses
Melting, refining, casting and manufacturing may result in unavoidable process losses.
Cloverfield does not guarantee that 100% of the original gross weight will be recoverable as usable metal.
Additional metal
If additional metal is required to manufacture your new piece, you may be required to pay for the additional metal.
This will be discussed with you where applicable.
Remaining metal
If recoverable metal remains after your jewellery has been manufactured, the treatment of that remaining material should be agreed with you before production.
Depending on the arrangement, it may be:
  • Returned to you;
  • Credited against your order;
  • Purchased by Cloverfield at an agreed value; or
  • Otherwise dealt with as agreed in writing.
You may provide your own gemstones for incorporation into a new piece.
Before manufacturing, Cloverfield may inspect and photograph your gemstone and record its condition.
Where practical, we may record:
  • Measurements
  • Weight
  • Visible inclusions
  • Chips
  • Cracks
  • Abrasions
  • Existing damage
  • Other visible characteristics
Important
Removing a gemstone from an existing setting may reveal damage that was previously hidden.
Some gemstones may also be particularly sensitive to heat, pressure, chemicals or manufacturing processes.
If we believe that your gemstone is unsuitable or presents an unreasonable risk of damage, we may recommend that it not be used.
We take utmost care of your gemstones, but we do not carry liability for stone damage when removing or setting your gemstone.
We will not knowingly substitute your gemstone without your authorisation.

Any gold, jewellery, gemstones or other property supplied by you remains your property unless we have agreed otherwise in writing.
Cloverfield will exercise reasonable care, diligence and skill in safeguarding customer property while it is in our possession.
We recommend that clients keep photographs and records of valuable items before handing them to us.

Custom jewellery is individually manufactured and may have reasonable manufacturing tolerances.
Minor variations may occur in:
  • Metal weight
  • Dimensions
  • Thickness
  • Surface finish
  • Symmetry
  • Polishing
  • Setting appearance
A minor variation does not automatically constitute a defect where the jewellery remains materially consistent with the approved design and specifications.
This does not affect your statutory rights regarding defective goods. Where a genuine manufacturing defect or workmanship issue is identified, Cloverfield reserves the right, at its discretion and where permitted by applicable law, to repair or replace the item rather than provide a refund.
Our standard custom manufacturing timeframe is approximately 3–8 weeks, depending on the complexity of the piece.
This is an estimated timeframe unless a specific completion date has been agreed in writing.
Manufacturing may take longer because of:
  • Design changes
  • Delayed approvals
  • Delayed payments
  • Gemstone availability
  • Supplier delays
  • Casting
  • Specialist setting
  • Engraving
  • Courier delays
  • Public holidays
  • Unforeseen manufacturing issues
  • Circumstances outside our reasonable control
We will make reasonable efforts to keep you informed of significant delays.
Clients are responsible for providing or approving their required ring size.
If the wrong size is supplied or approved by the client and the jewellery has been manufactured according to that approved size, additional charges may apply for resizing or remanufacturing.
Ring sizing should be carefully considered before approval.

Because our jewellery is custom-made specifically to each client's requirements, custom pieces cannot be returned simply because of a change of mind, dissatisfaction with a design that was approved, or because the client no longer wishes to proceed with the purchase, subject always to any rights provided by South African law.
We ask that any concerns regarding workmanship, defects or damage be reported to Cloverfield as soon as reasonably possible, preferably within 7 days of receiving the jewellery, so that we can promptly inspect and address the concern.
The 7-day reporting period does not limit any statutory rights the client may have under the South African Consumer Protection Act.
Where Cloverfield determines that an issue is the result of a genuine manufacturing or workmanship defect, we will address the matter in accordance with the Consumer Protection Act and applicable law.
For custom-made jewellery, Cloverfield reserves the right to repair or replace the jewellery where permitted by law, and the client's statutory rights regarding defective goods remain unaffected.
Normal wear and tear, accidental damage, misuse, improper care, damage caused by impact, unauthorised repairs or alterations, and the natural characteristics of gemstones do not automatically constitute a manufacturing defect.

Unless otherwise agreed in writing, Cloverfield retains ownership of its original:
  • Design concepts
  • CAD files
  • Technical drawings
  • Templates
  • Manufacturing files
  • Design methods
  • Other proprietary design material
Purchasing a finished jewellery item does not automatically transfer ownership of the underlying CAD files or technical design files.
CAD or technical files may be supplied separately where agreed and may be subject to an additional fee.
Cloverfield will handle personal information in accordance with applicable South African privacy legislation.
Personal information will only be collected and used for legitimate business purposes, including:
  • Processing orders
  • Communicating with clients
  • Providing quotations
  • Manufacturing jewellery
  • Processing payments
  • Delivering orders
  • Managing complaints
  • Maintaining business records
  • Complying with legal obligations
Cloverfield will not be responsible for unreasonable delays caused by circumstances outside our reasonable control.
This may include:
  • Natural disasters
  • Fire
  • Flood
  • Extended power failures
  • Serious equipment failure
  • Supplier failure
  • Transport disruption
  • Industrial action
  • Government restrictions
  • Civil unrest
  • War
  • Other extraordinary circumstances
We will make reasonable efforts to communicate significant delays and resume work as soon as reasonably possible.
To the maximum extent permitted by South African law, Cloverfield will not be responsible for problems caused solely by:
  • Incorrect information supplied by the client;
  • Incorrect measurements supplied or approved by the client;
  • Client-approved design specifications;
  • Natural characteristics of gemstones;
  • Pre-existing damage;
  • Normal wear and tear;
  • Accidental damage;
  • Misuse;
  • Improper care;
  • Unauthorised alterations or repairs; or
  • Circumstances outside Cloverfield's reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
Subject to South African law, Cloverfield reserves the right to:
  • Refuse an order where the requested work cannot reasonably be performed;
  • Refuse materials that are unsuitable or unsafe to process;
  • Request additional information before beginning work;
  • Require payment before proceeding with further work;
  • Suspend work where an account is overdue;
  • Charge agreed additional costs resulting from client-requested changes;
  • Use appropriate specialist manufacturers;
  • Inspect jewellery before determining the cause of an alleged defect; and
  • Cancel an order where lawful performance becomes impossible.
